OSAKA – On April 11, 2009, Funai announced that the U.S. International Trade Commission (“ITC”) issued a final determination and remedy order on April 10, 2009, finding that VIZIO and other respondents infringe Funai’s digital television patent (US Patent No. 6,115,074) and barring such respondents from importing or selling infringing DTV products in the U.S.
Prior to the ITC’s final determination, on March 11, 2009, an examiner with the United States Patent and Trademark Office (“USPTO”) issued an Office Action in the pending reexamination of the ’074 Patent, rejecting claims of such patent. The Office Action does not invalidate the ’074 Patent and does not affect the ITC’s final determination and remedy order. The nature of the Office Action is as follows:
(1)The USPTO’s notice of March 11, 2009 is not the final action in the examiner’s review of the claims. The ’074 Patent remains valid.
(2) Funai will file a response to the USPTO’s Office Action by May 11, 2009. Funai believes that the validity of the ‘074 Patent will be affirmed at the conclusion of the reexamination, including any necessary appeals to the Board of Patent Appeals and Interferences and the Court of Appeals for the Federal Circuit. No finding of invalidity is final until all of these steps are exhausted.
Funai remains committed to respecting the intellectual property rights of others and will continue vigorously protecting its own intellectual property rights against infringers.
